Former top judge of Gilgit-Baltistan Supreme Appellate Court has challenged his indictment saying that excluding others from arraignment and charging him only is illegal, reported 24NewsHD TV channel on Tuesday.
The former GB judge submitted an intra court appeal. In his petition, he stated that sparing others who published the affidavit and arraigning him alone was illegal. He prayed to the court to dispose of the case after declaring his indictment null and void.
The petitioner said there was no record that proved that he gave his affidavit for publication.
Rana Shamim made journalist Ansar Abbasi, who published the story in daily The News and the editor and editor in-chief of the newspaper as party to the case.
He said if Nisar Abbasi was out from trial, how could the court know that how did he get the affidavit. The main accused of the case was discharged on the assurance of private people. In legal practice, such things could not be imagined that somebody would be discharged on private people’s assurances.
The petitioner once again said that he did not ask anybody to publish his affidavit.
