SC releases detailed verdict in Askari-IV multi-storey building cases

The Supreme Court Friday issued the detailed verdict in the case against stopping the construction of a multi-storey building in Askari-IV in Karachi, the 24NewsHD TV channel reported.

The five-page judgment was written by Chief Justice Qazi Faiz Isa, stating that the application of the Army Housing Directorate is dismissed as inadmissible.

The Army Housing Directorate approached the Supreme Court against the decision of the High Court.

It was written in the judgement that the Housing is a part of the federal government which has no independent legal status, it said, adding that Askari Housing or its officer-in-charge has no separate existence and Institutions under the federal government cannot hire private lawyers in their cases.

The verdict maintained that it is necessary to take permission from the Law and Justice Division to hire private advocates for subsidiaries and Army Housing Directorate cannot file an application for lack of separate legal entity.

Army Housing Directorate Lawyer Abdi Zuberi was asked about the legal existence of the Army Housing Directorate and the appointment of a private lawyer and he did not have an answer to the question.

A three-member bench headed by the Chief Justice of Pakistan heard the case on October 25.
