The dissenting note of Justice Aminuddin and Justice Naeem Akhtar in the case of the PTI reserved seats has been released.
The 29-page note said a detailed decision could not be released even after 15 days and the delay may affect the review.
In the dissenting note, the two judges showed reservations about the majority judgement.
They added PTI was not a party in the case and the relief to PTI would have to go beyond the jurisdiction conferred in Articles 175 and 185.
The dissenting note stated that the majority judgment ignored fundamental provisions of the law and the Constitution and Article 51, Article 63 and Article 106 will have to be suspended to give relief to PTI.
Relief cannot be granted to the PTI as it was not the petitioner before the court, it said, adding the PTI did not even try to become a party before the ECO and the court and it did not even claim to be entitled to reserved seats.
