LHC declares arrest in same case after bail illegal

The Lahore High Court (LHC) declared illegal re-arrest after bail in a single case under the new provisions, 24News HD TV Channel reported on Monday.
According to the details, the Court has set a new legal rule for the first time in criminal cases.
Justice Ali Zia Bajwa issued a 10-page written decision on Mujtabi Saleem Butt's petition for a recovery of his son named Rashid Hasan Butt.
According to the verdict, law enforcement agencies cannot be allowed to violate court orders, if the court grants bail to an accused, the concerned agencies should respect it.
Justice Ali Zia Bajwa said in the decision that the accused cannot be arrested under new charges after being released as the right of freedom of any person cannot be undermined.
The decision further said that the police has violated the court orders by not following the legal procedure, the police has also violated the court orders and the constitutional rights of the accused by doing this.
On Monday, the hostage was presented on the court order and the investigator said that the accused was arrested by Sherakot Police Station under Section 381A.
The court was informed that the interim bail of the accused has already been granted in the same case, despite which the police has arrested the accused by introducing new provisions in the same case.
