Chief Justice Qazi Faez Isa has released a detailed 10-page verdict regarding the general election case, as reported by 24News HD TV Channel on Sunday.
In the comprehensive verdict, Chief Justice Qazi Faez Isa elaborated on the decision to hold the election on February 8, highlighting that this decision was reached following consultations with President Arif Alvi and the Election Commission of Pakistan (ECP).
It was stated that the Election Commission of Pakistan claims to have the process of constituency demarcation completed by November 30 and the election program will be announced afterwards.
The verdict commended the Attorney General’s efforts to get all the parties to agree on the date of elections.
According to the constitution, the elections were to be held within 90 days of the dissolution of the assembly but due to the seventh census, it was not possible and the polls were delayed.
The President's decision to dissolve the Assembly on April 3 was unconstitutional but the removal of the prime minister through a no-confidence movement is enshrined in the constitution.
It is clearly stated in the constitution that a majority of the assembly members can pass a motion of no confidence and the Prime Minister cannot order the dissolution of the assembly after the no-confidence movement.
Isa’s verdict stated that the President's dissolution of the assembly created a political crisis in the country. Supreme Court took immediate notice of the political crisis itself and annulled the order to dissolve the assembly after the no-confidence movement.
In the case against the no-confidence motion, a judge’s decision branded the president's dissolution of the assembly as treason and his case was left to the Parliament.
