Hafeezullah Niazi, the father of Hassaan Khan Niazi, PTI leader and party Chairman Imran Khan’s nephew, on Monday filed a petition in the Supreme Court (SC), seeking the court’s declaration that the arrest and trial of his son by a military court was ‘unconstitutional’, reported 24NewsHD TV channel.
Arguing that there was no provision in the constitution for the trial of civilians in military courts and that it contravened Article 10-A of the constitution, Hafeezullah, in his petition, also requested the court to declare the Army Act and Official Secrets Act ‘unconstitutional’.
The petition read that Hassaan was referred to a military court without permission from any court.
PTI leader Hassaan Khan Niazi had been handed over to the Pakistan Army for a trial over his alleged involvement in vandalism at Lahore’s Jinnah House during the May 9 violence, which was sparked by the former prime minister’s arrest.
