The Islamabad High Court on Monday dismissed a petition seeking to put the name of former top judge of Gilgit-Baltistan Rana Shamim on the Exit Control List, besides rejecting the petitioner’s request to become party to the case, reported 24NewsHD TV channel.
The IHC after declaring the petition submitted by Mohammad Nawaz Kharal non-maintainable threw it out on Monday.
IHC Chief Justice Athar Minallah released the written order of the ruling.
The judge observed that the matter of contempt was between the court and the alleged contempt offender. Apart from the offender, no one could become the party to the case, he added.
He further remarked that the petition to become party to the case was a result of misunderstanding and it was not maintainable.
Earlier, the IHC reserved its judgement on the petition requesting the court to place former top judge Rana Shamim’s name on the Exit Control List.
ICH Chief Justice Minallah reserved the verdict after hearing arguments from the petitioner’s lawyer. The court also reserved its judgement over petitioner Rai Nawaz Kharal advocate’s request to become a party to the case.
The petitioner’s lawyer requested the court to put Mr Shamim’s name on the ECL lest he should flee the country before or after starting the hearing of contempt case against him. He further pleaded with the court that Mr Shamim must be ordered to surrender his passport.
Chief Justice Minallah remarked that placing name of a citizen on the ECL was government job not that of the court’s job.
