The Supreme Court of Pakistan Wednesday ordered a fine of Rs 100,000 and legal proceedings against a husband for delaying the payment of haq mehar to his wife for six years.
The court ruled that husbands are obligated to pay haq mehar whenever their wives demand it.
Emphasizing haq mehar as a Shariah requirement protected by the country’s laws, the court stated that if the marriage certificate does not specify the time for payment, the wife can demand haq mehar at any time.
The case reached the Supreme Court after the wife filed a suit for haq mehar six years after the marriage.
The court expressed concern about unnecessary appeals, suggesting that penalties for such appeals could prevent such situations in the future.
Chief Justice Qazi Faiz Isa wrote the three-page judgment and dismissed the appeal against the haq mehar payment order to Khalid Parvez’s wife, Samina.
