SC fixes intra-court appeals against military trials decision for hearing

The Supreme Court of Pakistan has fixed for hearing the intra-court appeals against the SC decision in a case regarding civilians’ trial in the military courts and the applications filed by SC Justice Mazahar Ali Akbar Naqvi against the proceedings of the Supreme Judicial Council, reported 24NewsHD TV channel on Saturday.


According to sources, the hearing on the applications of Justice Mazahar Ali Naqvi will be held on December 15.


A three-judge bench to be headed by Justice Aminuddin Khan and comprising Justice Jamal Mandokhel and Justice Musarrat Halali will hear the case.

Besides this, the hearing on intra-court appeals against the decision in a case related to civilians’ trial in the military courts will be held on December 13.


A six-judge larger SC bench to be led by Justice Sardar Tariq Masood will hear the intra-court appeals against the military courts decision.


Justice Aminuddin Khan, Justice Hassan Azhar Rizvi, Justice Muhammad Ali Mazhar, Justice Musarrat Halali and Justice Irfan Sadat will also be part of the larger bench.


It should be noted that on Nov 17, the federal government and the Ministry of Defence filed intra-court appeals against the decision of a five-member bench that had declared the trials of civilians under the Pakistan Army Act 1952 as unconstitutional.


In its Oct 23 ruling, the SC bench, comprising Justices Ijazul Ahsan, Munib Akhtar, Yahya Afridi, Syed Mazahar Ali Akbar Naqvi, and Ayesha Malik had declared that trying civilians in military courts for their alleged role in attacks on army installations during the riots that followed former PTI chairman Imran Khan’s arrest were ultra vires the Constitution. The bench had also emphasised that the cases of the suspects involved in the vandalism would proceed before criminal courts.
