Govt will challenge verdict barring action against retired judges, SJC told

 The Chief Justice of Pakistan has deferred the proceedings of the Supreme Judicial Council against Justice ® Mazahar Ali Akbar Naqvi till February 15, reported 24NewsHD TV channel.


The SJC held an importance meeting on Friday in which the matter of complaints against retired Justice Mazahar Naqvi came under discussion.


The SJC meeting which was held under the chair of Chief Justice Qazi Faez Isa has sent a notice to Mazahar Naqvi and his lawyer Khawaja Haris.


Mazahar Naqvi who is facing charges of wrongdoing and misconduct resigned from the post of Supreme Court judge on Wednesday and his resignation was accepted by the President on Thursday.
The lawyer of retired judge, Kh Haris, did not attend the SJC proceedings today.


However, the registrar read out the reply sent by Khawaja Haris, in which it was stated that the council can only take action against a judge of the Supreme Court, not a retired judge.


The Attorney General said that the government is filing an appeal against the decision not to take action against the retired judge in the Aafia Shehr Bano case.


The assistant lawyer of Khawaja Haris said that Khawaja Haris is coming from Lahore now, we have objection to the action of the council, Mazahir Naqvi is no longer a judge and action should not be taken against him.


The Chief Justice said that according to the decision of the Aafia Shehr Bano case, the Supreme Judicial Council could only take action against the judge, this case would be heard again after the elections on February 8, it would be appropriate to hear it on the 15th, 16th or 17th of February.


Later, the proceedings of the Supreme Judicial Council were adjourned till February 15.


The council wrote today's order in which it was stated that the Attorney General said that he was filing an appeal against the decision of Aafia Shehr Bano. Now this meeting would be held on February 15 at 11;30 am.
