The Legislation Wing of the National Assembly (NA) secretariat Monday told Speaker Asad Qaiser that no parliamentarian as per the law could be barred from casting vote, reported 24NewsHD TV channel.
The NA speaker had asked from the Legislation Wing whether the disgruntled parliamentarians of the Pakistan Tehreek-e-Insaf (PTI) could be stopped from casting votes in the no-confidence motion.
“Article 63-A of the Constitution is quite clear. If a parliamentarian violates the policy of his party, action will be taken against him later,” the Legislation Wing told the speaker.
“Can any action be taken if names of the suspected parliamentarians come from the party leadership?” asked the speaker.
“After a formal declaration by the party chairman, the role of the speaker begins,” the Legislation Wing informed the speaker.
“Can ruling against the disgruntled parliamentarians of the party be given in the House before voting for the no-confidence motion?” asked the speaker.
“It’s the speaker’s prerogative to give a ruling. However, law and Constitution are clear on this,” said the Legislation Wing.
