The Lahore High Court has issued a notice to the Election Commission for tomorrow (Tuesday) on the appeal against the rejection of former premier and PTI founder Imran Khan's nomination papers, reported 24NewsHD TV channel.
A three-member bench headed by Justice Ali Baqir Najafi and comprising Justice Shahid Bilal and Justice Jawad Hassan on Monday heard the petition of PTI founder against the rejection of his nomination papers.
Aziz Bhandari advocate appeared on behalf of Imran Khan in the court.
The lawyer told the court that the PTI founding chairman has submitted papers for election from National Assembly constituencies NA 122 Lahore and NA 89 Mianwali.
He said the nomination papers submitted in both the constituencies were rejected on the same Toshakhana allegations. While rejecting the papers for NA 122, it was alleged that the proposer was not a voter of the constituency. According to the law, nomination papers can be rejected on the two-year sentence.
The lawyer further said that there is no other charge in NA 89 except the Toshakhana punishment. Punishment in Toshakhana was given on the basis of moral turpitude. There is no interpretation of moral turpitude in judicial decisions.
The court inquired from the lawyer of Election Commission whether the petitioner was sentenced for moral turpitude. How much punishment was given, to which the ECP lawyer replied that he would assist the court on this matter. The petitioner was awarded two sentences.
The PTI founder’s lawyer said that the returning officer and the Appellate Tribunal relied on the arguments of the Toshakhana's sentence.
Later, the court issued a notice to the Election Commission for rejecting the nomination papers of Imran Khan for tomorrow.
