PTI has submitted a reply to the Election Commission of Pakistan’s objection over its intra-party elections, reported 24newsHD TV channel.
PTI’s central chief Election Commissioner Rauf Hassan submitted the reply which comprised five pages. PTI claimed in its reply that section 208A of the Election Commission Act did not apply to it as PTI transparently completed the intra-party elections on 9 June 2022 and 23 November 2023.
PTI was an active political party and there was no justification for taking action against PTI under section 202 of the Election Commission of Pakistan Act.
It was elaborated to ECP that the general body meeting of PTI was held on 31 January 2014 while members from the four provinces participated in the general body meeting.
PTI claimed that its members and workers were prevented from attending the general body meeting by the police due to which most of the members attended the meeting via Zoom. Moreover, the general body meeting approved the appointment of Chief Organizer and Federal Chief Election Commissioner and PTI submitted all the details to the Election Commission within 7 days after holding the election on March 3.
PTI said all the members of the party participated in the general body meeting. However, regarding the general body session, the party constitution was silent. However, various court decisions were also made part of the response to the objections to the appointment of the Federal Chief Election Commission by the National Council.
PTI said it had only one option to take decisions through a general body meeting as the Election Commission of Pakistan has no objection to holding party elections on March 2.
PTI claimed that the appointment of the Chief Organizer by the General Body was as per law. During the current circumstances, it was the competent dynamic body through which the appointments were made.
Moreover, PTI submitted 1365 pages of details on intra-party elec and ECP did not find any flaw in the documents. Therefore PTI urged ECP to recognize the intra-party elections and issue the party certification to it.
PTI said that ECP cannot take action under clause five of Article 208 and no action can be taken against the listed political party under Section 202.
