A two-member bench of Lahore High Court on Monday suspended a single bench decision against arresting former Punjab chief minister Parvez Elahi in classified cases, reported the 24NewsHD TV channel.
The bench headed by Justice Ali Baqar Najafi and Justice Aalia Neelum of Lahore High Court (LHC) heard the appeal of the Punjab government in which a local court's order granting protective bail to former Punjab chief minister and Pakistan Tehreek-e-Insaf (PTI) President Pervaiz Elahi was challenged.
The government had challenged the single bench decision not to arrest Elahi in classified cases and granting him protective bail.
The two-member bench suspended the decision and issued notices to the parties concerned.
In its appeal, the government had adopted the stance that the decision of the single bench was against the facts and law. It said that institutions were investigating various cases against Parvez Elahi, interrogating him according to the law.
The appeal had sought to set aside the judgment of the single bench.
Further action on the government’s appeal will take place on Aug 1.
Earlier, Advocate General and other law officers appeared on behalf of the Punjab government in the LHC.
Punjab advocate general held that the bench gave a decision contrary to the facts on the petition of the ex-Punjab CM.
He contended that Elahi is being investigated by the concerned investigating agencies as per the law, adding that the single bench has ignored the legal requirements in the judgment.
The provincial government has requested the Lahore High Court (LHC) to declare the decision of the single bench null and void and order the immediate suspension of the decision.
He added that the single bench also granted protective bail in the Ghalib market case, which was dismissed for non-compliance.
Parvez Elahi was also given protective bail in a case of anti-corruption Gujarat, he said, adding that the single bench gave relief to Chaudhry Parvez Elahi which he did not even ask for.
