Lahore Hight Court, while hearing of NAB appeal against former Punjab Chief Minister Ch Parvez Elahi’s plea seeking NAB inquiry reports and other documents on Accountability Court’s orders, grilled at NAB Prosecutor Waris Janjua for his failure to satisfy court in the case, reported 24NewsHD TV channel.
A two-member bench headed by Justice Tariq Saleem Sheikh heard the PTI leader’s application. Prosecutor Waris Janjua appeared on behalf of NAB while Aamir Saeed Ran advocate appeared on behalf of Chaudhry Parvez Elahi.
The Lahore High Court after hearing the arguments of NAB prosecutor dismissed their application with a fine of two lakhs.
Justice Tariq Saleem Sheikh remarked during the hearing that despite the court’s order, documents were not being provided therefore we should summon Chairman NAB who was not providing documentary evidence to Ch Parvez Elahi.
LHC Justice Tariq Saleem Sheikh further remarked that it seemed that NAB chairman claims himself to be above the law. Justice Tariq stressed that it was the firsts and foremost responsibility of the court to protect human rights.
NAB prosecutor contended that reference against Parvez Elahi and other accused were under the proceeding therefore Accountability Court ordered can not be fulfilled. The prosecutor contended that copies of inquiry documents and witness statements cannot be provided to the accused. And Accountability Court order was not appropriate.
Public Prosecutor urged LHC bench to declares the Accountability court ordered null and void.
Parvez Elahi counsel Aamir Saeed Ran contended that in Accountability Court NAB has not refused to do so. He said NAB was using delaying tactics for the last two months. And NAB team was trying to make lame excuses about it. He urged the LHC bench to give them right to fair trial and ordered NAB to give them documents.
After hearing of the arguments on both side, LHC bench dismissed NAB petition along with imposing 2 Lakh fine to the NAB for not complying court’s orders.
