LHC annuls Imran Khan’s physical remand in 12 May 9-related cases

What could be described as a big relief to the former prime minister and PTI founder Imran Khan, the Lahore High Court (LHC) on Thursday accepted his appeal against his physical remand granted to the police in 12 May 9-related cases, reported 24NewsHD TV channel.


The court also declared the notification issued for the appearance of the former prime minister in the court via a video link null and void.


Earlier in the day, the court reserved its verdict in the case.


During the hearing, Justice Tariq Salim Sheikh said that proving the charge of spreading chaos in society against an individual was the most difficult task. “The question is, why do you people insist on the PTI founder’s physical remand?”


“You want to conduct his polygraph test. But he is still in judicial custody. You yourself have said that a magistrate has all the rights to order the polygraph test of Imran Khan,” the judge remarked.


Justice Sheikh said the timing of the suspect’s arrest in these cases was very important.


Justice Anwar-ul-Haq Pannu said these were the judges who were being threatened the most. “May I know when after the May 9 incidents of violence you decided to conduct voice matching and other tests of the former prime minister?” he questioned.    


The judge questioned when the government knew that Imran was in jail, why was he not arrested during his detention?”


Justice Pannu further asked how giving a call for protests could be termed a crime. “If the petitioner in the case had led these protests, then surely this would have been a crime,” he remarked.
