Intra-court appeal against Navy Club decision of IHC filed, Registrar Office objects

Ministry of Defense Friday filed an intra-court appeal against the Islamabad High Court’s (IHC) decision about demolishing the Navy Sailing Club and Farms.

According to the 24News HD TV channel, the IHC Registrar's Office has objected to the intra-court appeal to quash the decision of Chief Justice Athar Minallah.

In the appeal, the ministry requested the court that it should declare null and void the single bench’s declaration against the Navy and the Armed Forces.

The appeal said that the Navy had established the facility of Water Sports Center on the instructions of the Prime Minister in 1992.

The appeal has also raised some constitutional matters and said the Constitution of Pakistan does not explicitly state that one has to give one's life for the protection of the homeland.

Though the constitution says only to defend the homeland but does not say to give one's life or take the life of the enemy, the appeal said adding that should the soldiers come back that defense is not possible without deviating from the constitution?

But, we sacrifice our lives and take the enemy’s lives for the sake of our homeland despite it is also not written in the constitution, the appeal added.

The appeal further said that the declaration in the decision has led to a decline in morale.

The IHC Chief Justice had directed the Capital Development Authority (CDA) to demolish the Navy Sailing Club and take possession of the farms in his decision.
