New details of IHC judges' letter to president, chief justice of Pakistan surface

Five judges of the Islamabad High Court (IHC) has written a letter to the president of Pakistan, chief justice of Pakistan and chief justices of the Sindh High Court (SHC), Lahore High Court (LHC) and IHC. 

The judges who have written the letter are Mohsin Akhtar Kayani, Tariq Mehmood Jahangiri, Justice Babar Sattar, Miangul Hassan Aurangzeb and Arbab Muhammad Tahir. 

They have written in the letter that a judge transferred to the IHC from LHC cannot become chief justice of the IHC according to the constitution. The letter says that a judge takes the oath for the court he works at. If a judge is transferred to the IHC, the letter says, he will have to take a fresh oath under Article 194 of the Constitution before resuming his duties. It says that seniority of the transferred judge will be decided on the basis of his fresh oath. It says the Supreme Court has already ruled that seniority of a judge will be determined from the day of his oath.
