Suo Motu notice regarding elections in Punjab and Khyber Pakhtunkhwa in Supreme Court, Justice Yahya Afridi issued a detailed note containing seven pages on Friday evening.
According to the 24News HD TV channel, in a detailed note, Justice Yahya said the Suo Motu notices and constitutional petitions are not maintainable for adjudication of the SC under Article 184 (3).
Justice Yahya said in the note that the court should avoid interfering in political matters. He observed that the Chief Justice should not have taken Suo Motu notice of the Punjab and Khyber Pakhtunkhwa election issue himself.
He said the Supreme Court has decided that if the case is heard in the High Court, then the Supreme Court should show restraint in it.
He also said that it was not appropriate for him to be a part of the bench but the Chief Justice himself should decide whether he should be a part of the 9-member bench or not.
