Presidential ordinance to appoint retired judges to election tribunal challenged in LHC

The presidential ordinance regarding the appointment of retired judges to election tribunals has been challenged in the Lahore High Court on Thursday.

According to the 24NewsHD TV channel, the petition was filed by a citizen Mashkoor Hussain who has made the federal government, the Ministry of Law, and other parties respondents in the case.

The petitioner argued in his petition that the presidential ordinance is based on malintent. He mentioned that the Lahore High Court has already given a decision regarding the appointment of tribunals so this ordinance cannot be applied to the 2024 elections.

The petition appealed to the Lahore High Court to declare the presidential ordinance illegal and unconstitutional and to suspend its implementation until the final decision on the petition.

Pertinent to mention here that three days ago, Acting President Yousuf Raza Gilani signed the Elec­tions Act (Ame­nd­m­ent) Ordinance 2024 on the advice of Prime Minister Shehbaz Sharif.

Under this ordinance, the election commission could appoint retired judges as members of the election tribunals besides serving judges.
