CJP punches holes in Faizabad Sit-in Inquiry Commission report

Supreme Court (SC) bench headed by Chief Justice of Pakistan (CJP) Justice Qazi Faez Isa termed the Faizabad sit-in Inquiry Commission's report a childish thing which has no recommendations and comprises a statement of retired Gen Faiz Hameed and against the Punjab government and Rana Sanaullah.
During the hearing of the Faizabad sit-in case on Monday, CJP Justice Qazi Faez Isa said the Commission report is something to be given to grade five children as it has only wasted time and did not produce any results. Even the inquiry commission did not say who violated the oath, he added.
Justice Qazi Faez Isa said that I did not understand at what level the mind had prepared the report because the commission did not know what was their responsibility and prepared it based on just Faiz Hameed's statement.
Justice Qazi Faez Isa said that no one cares about the loss of Pakistan and setting a fire and vandalism has now become the right of some people.
The CJP said that in one paragraph of the report, it is claimed that financial matters are not the responsibility of ISI but in the other paragraph it is written that no evidence of financial support of TLP [Tehreek-e-Labbaik Pakistan] was found.
He said the commission was saying that those [protesters of TLP] who were staging a sit-in in Faizabad were not responsible but the Punjab government.
Justice Qazi Faez Isa said how could the Punjab government stop the protesters from coming to Islamabad? Protesting and moving to another city is a fundamental right of any citizen of Pakistan.
He further said how can the commission say that the protestors should have been stopped in Punjab. Such thing showed some grude of the inquiry commission against Punjab government as the entire focus of it was only on why the protesters were allowed to come from Punjab to Islamabad, the CJP said adding that the commission has written the entire report against the Punjab government for not interfering in the sit-in.
The CJP said the commission has also been in the police, but it seems that they had a special enmity with the police and have settled a score with their old colleagues through this report.
He said the Commission of Inquiry is not writing anywhere that the protestors did wrong and suggesting by saying there are laws so follow them. "Thank you very much, did we need to create a commission to say this?" the CJP said.
Justice Qazi Faez Isa also raised the question about why the commission did not call anyone on behalf of TLP [protesters] for inquiry? Perhaps the commission was afraid while calling TLP, he said.
The CJP said the commission said Rana Sanaullah was the head of the committee of the Punjab government and did not do anything, perhaps it had a problem with him too.
Justice Qazi Faiz Isa also pointed out the role of PEMRA and said it showed hurryness in every thing but did not do anything in the matter of the Faizabad sit-in.
Justice Qazi Faiz Isa said that the inquiry commission took the power of the parliament and the court but did not do the work it was supposed to do. He further said if the people of the inquiry commission did not know English, they would have written in Urdu.
During the hearing, Justice Irfan Saadat said that the Faizabad Sit-in Inquiry Commission put all the blame on the Punjab government and recorded the statements of those who delivered breakfast and food to the protesters but did not recorded statements of TLP.
Justice Naeem Akhtar Afghan said that the inquiry commission was supposed to give recommendations but did not give anything and he did not understand what the inquiry commission was afraid of.
Attorney General Mansoor Usman Awan informed the SC bench that it was not the responsibility of ISI to look into financial matters on which the CJP said if it is not his responsibility, then whose responsibility is it?
The Attorney General told the SC bench that the head of the Inquiry Commission is also present in the court and if the court has any question related to the report, it can be asked to him.
The Attorney General acknowledged that the inquiry commission was asked for recommendations but they were not given. He also admitted that there is no statement of any member of TLP in the inquiry commission report.
