Transgender activist Nayyab Ali challenges Shariat court decision

Transgender activist Nayyab Ali Saturday filed an application in the Supreme Court against the decision of the Federal Shariat Court on the transgender act, the 24NewsHD TV channel reported.

The Federal Shariat Court in Islamabad on May 19 ruled that sections 2(f), 3 and 7 of the transgender act are against the teachings of Islam.

Nayyab Ali made a request to the top court to annul the Federal Shariat Court decisions taken on May 19.

The Shariat court verdict stated that Islam does not allow anyone to change their gender as per their will and an individual’s gender shall remain the same as the one they are born with.

Section 7 of the transgender act was declared unlawful as it allowed individuals to determine their gender for inheritance. The decision stated that the inheritance should be according to the biological sex of the individual. It also stated that an individual, irrespective of their gender, cannot identify themselves as Khawajasira if they deviate from their biological sex.

Nayyab Ali made the federal government and the Ministry of Human Rights parties in her petition.
