IHC voids Islamabad LG Ordinance, bars polls under it

The Islamabad High Court has declared the Islamabad Local Government Ordinance null and void barring administration to hold elections under this ordinance, reported 24NewsHD TV channel.

IHC Justice Mohsin Akhtar Kiyani on Wednesday pronounced judgement on the petitions which were challenging the Islamabad Local Government Ordinance. The court ruled that the LG elections could not be held under the new ordinance in place of the Local Government Act.

The judge announced the reserved verdict on the petitions submitted by former UC chairman Sardar Mehtab, CDA labour union, CDA officers association and others. 

Barrister Umar Ijaz Gilani, Qazi Adil, Kashif Malik and other lawyers representing petitioners presented their arguments before the court. 

The new ordinance which was promulgated when the Local Government Act still existed was challenged in the court.

The government lawyer told the court that that parliament session was completed on Nov 19 and the ordinance was promulgated on Nov 23. 

The petitions also raised objection over limiting powers of chairman in the LG Ordinance.

They also raised question over the future of the elected representatives as the ordinance had not been turned into law.
