Advocate General Punjab (AGP) Ahmed Awais has given his legal opinion on the letter of Punjab Governor Omar Sarfraz Cheema and termed the resignation of Usman Buzdar and the election of Hamza Shehbaz as chief minister unconstitutional.
According to the 24News HD TV channel, the Punjab Governor had sought constitutional opinion on the resignation of Usman Buzdar from the AGP and now following the reply, he has called a meeting of constitutional experts after Iftar for further action on the matter.
The channel report said the AGP has declared that Usman Buzdar's resignation is a violation of Article 130 (8) of the Constitution.
AGP Ahmad Awais coined his constitutional opinion that Usman Buzdar as Chief Minister did not write his resignation in the name of the governor as well as he did also not write his resignation in his own handwriting.
The AGP further explained that under the constitution, the chief minister should have written his resignation in his own hand.
On the other hand, the AGP office sources said that in the reply to the Governor’s letter, Ahmad Awais has also given an opinion that the Chief Minister was not elected in accordance with the Assembly Rules and the Constitution so Hamza Shahbaz cannot be called Constitutional Chief Minister of Punjab.
The AGP further explained that the decision of the Lahore High Court (LHC) was not implemented during the election of the Chief Minister while the Deputy Speaker Dost Mazari presided over the Punjab Assembly session from the gallery which was a violation of the assembly rules.
