The Lahore High Court Monday issued a stay order on the collection of property tax by the Lahore Cantonment Board, reported 24NewsHD TV channel.
This decision came in response to a constitutional petition filed by Elite Marquee, who received a notice for a hefty sum of 3.9 million in property tax.
The court has directed the Chief Executive of the Cantonment Board, along with other concerned parties, to submit a response within a fortnight.
The petitioner’s lawyer argued that the Cantonment Board lost its authority to collect property tax following the 18th constitutional amendment.
It was also pointed out that the Sindh High Court had previously nullified the Cantonment Board’s authority to collect property tax.
Despite these constitutional restrictions and court rulings, the Lahore Cantonment continues to issue property tax notices.
The petitioner has demanded that the court declare the Lahore Cantonment Board’s notice and authority to collect property tax as null and void.
