On one side is the state law and on the other side is the court decision, Law Minister Azam Nazeer Tarar said in the wake of the Supreme Court verdict on reserved seats on Monday.
“The parliament holds supreme legislative power and is above the verdicts of the Supreme Court,” he said while addressing a press conference.
He added: “The court did not give any opinion on the new amendment. Two basic amendments were made in the Election Act and both amendments are in the form of the law. Legislation is the right of Parliament.”
He recalled the verdict of the Peshawar High Court in which it upheld the decision of the Election Commission with a majority of five zero.
The federal minister said the PTI was not a party in cases in ECP, Peshawar High Court or Supreme Court while the loyalty of an independent candidate could not be changed after joining a party.
He stressed that the law is very clear that an independent candidate has to join a political party within 3 days therefore there is some confusion which will be cleared in a review.
He maintained that the detailed decision did not explain how the seats would be distributed while adding it was really disturbing to witness harsh words used by judges who wrote dissenting notes.
