The Islamabad High Court has suspended the written arrest order of 3 MPO under which former Punjab chief minister and PTI President Chaudhry Pervaiz Elahi was detained by the Islamabad police and ordered his release, reported 24NewsHD TV channel.
The court issued a notice to the parties including Islamabad DC for next Tuesday and sought their reply by the next hearing.
The judge directed Pervaiz Elahi to appear before the court on the next hearing.
The Islamabad High Court directed that Pervaiz Elahi would not give any statement until the next hearing. The court remarked that according to the petitioner's lawyer, there was no FIR registered against Elahi in Islamabad.
IHC judge Justice Tariq Mehmood Jahangiri heard the petition filed by Chaudhry Pervaiz Elahi to declare the MPO order null and void.
The judge inquired of the lawyer for how long Elahi had been in jail.
The lawyer replied he had been behind bars since June 1.
On this, Justice Jahangiri remarked that the PTI leader had been in jail for more than three months.
Elahi’s lawyer said that the former chief minister had been in jail for three months, how could he create a situation of peace?
Then the counsel read the 3 MPO order on the direction of the court.
He said that Elahi had not given any statement for four months and no case was registered against him in Islamabad.
The lawyer continued that Elahi was discharged in the anti-corruption case filed by the NAB. The Lahore High Court declared his arrest illegal and released him on Friday. But as soon as he came out of the court and was heading to his home, he was taken from the custody of the Lahore Police.
The judge inquired whether Elahi was involved in any commotion or procession in Islamabad.
The lawyer said that no rally, procession, or commotion was ever held by his client.
He said that contempt of court proceedings were also underway against the Islamabad DC for passing a similar order against PTI leader Shehryar Afridi.
