The District and Sessions Judge Islamabad quashed the trial court’s order of declaring Chief Minister (CM) Khyber Pakhtunkhwa (KP) Ali Amin Gandapur as an absconder, reported 24NewsHD TV channel on Thursday.


District and Sessions Judge Shahrukh Arjumand heard the appeal of CM KP Ali Amin Gandapur.


The court annulled the order declaring Ali Amin Gandapur as proclaimed offender after hearing the arguments of the lawyers.


Petitioner lawyer Raja Zahoorul Hasan and prosecutor Mohammad Salman Khan appeared before the court.


The court also approved Ali Amin Amin Gandapur's application for exemption from attendance.


Due to the busy official schedule, Ali Amin Gandapur cannot appear in the court, exemption should be granted, requested the lawyer.


It may be mention here that a case of arms and liquor recovery has been registered against Ali Amin Gandapur in Bahara Kahu police station.


The Judicial Magistrate declared Ali Amin Gandapur as an absconder for his continuous non-appearance.


The process server did not comply with the notices and the accused could not receive them, the court said.


Proceedings of section 87 and 88 against the accused are terminated, court ordered.


The court ordered petitioner to give bond of Rs50000 and one local surety.


The court sent the case back to the trial court and adjourned the hearing till March 14.
