Avenfield case: ‘Decision to be different, if there’s no evidence’

The Islamabad High Court (IHC) has stated the decision will be different if there is no evidence, 24NewsHD TV channel reported on Thursday.
A two-judge bench – consisting of Justice Aamer Farooq and Justice Mohsin Akhtar Kayani – was hearing the Avenfield reference appeal.
The court questioned the documents that form the basis of Maryam Nawaz's sentence. The trust deed of Maryam Nawaz is not fake, Justice Amir Farooq observed adding that Maryam Nawaz's trust deed mighty be pre-deed.
Justice Mohsin Akhtar Kayani asked what the case against Maryam Nawaz was. The court questioned who financed if Maryam Nawaz is a beneficial owner.
The court asked: “What will be the role of Maryam Nawaz even if he proves to be a professional owner? If a father makes the property illegally, will the daughter be guilty?”
There will be no adjournment today, Justice Mohsin Akhtar Kayani said adding that NAB should answer these questions first. The court was very clear as to why the time was being wasted, the judge said, adding that Maryam’s spouse was convicted just because he was a witness.
The observations of the Supreme Court were of the initial nature in 184/3. Even if the professional owner is proved, what will be the role of Maryam Nawaz? If the father has made the property illegally, will the son be guilty? Will the daughter be guilty?
The court asked if it was proven that the trust deed of Maryam Nawaz or Hussain Nawaz was not signed. During the hearing, Maryam Nawaz offered prayers in the court. The court directed all parties to view case papers and adjourned the hearing till February 17.
