Imran Khan challenges his indictment in cipher case in IHC

Pakistan Tehreek-i-Insaf founder Imran Khan challenged his indictment and the entire cipher trial proceedings in the Islamabad High Court on Tuesday, reported 24NewsHD TV channel.


In the petition, Imran requested the court to declare the proceedings of the cipher case held up until now null and void and he should be discharged in the case.


He pleaded that the proceedings of the trial court since November 23 are illegal and contrary to the requirements of justice. On December 12, the trial court rejected his plea in the cipher case.


He said that the trial court judge did not correctly interpret the word "complaint" in Section 13 (2)(3) of the Official Secrets Act, whereas the interpretation of the word "complaint" is clear in the law, in Section 4 (h) of the Criminal Procedure Code. The word (complaint) was also clarified.


He said that according to the law, complaints mean an oral or written plea before the magistrate on any charge, the cipher case under hearing against the founder PTI chairman is being conducted on the basis of an FIR and police report. The Official Secrets Act is a a special law which is different from the general law, being a special law it is necessary to adopt the legal procedure applying the Official Secrets Act.
