Chief Justice of Pakistan Qazi Faiz Isa has accepted the suggestions of ulema regarding Mubarak Saani bail case and withdrawn all objected paragraphs in the revised judgment, reported 24NewsHD TV channel.
CJP Faiz Issa read out the short verdict in Urdu. The CJP announced that all the objected paragraphs shall not be cited as precedent in any case. The Supreme Court said the amended detailed judgment on the revision petition will be issued later.
The CJP further ordered that the trial court should proceed by ignoring the deleted paragraph. The Supreme Court said the trial court will not be affected by the decision of the apex court on February 6 and July 24, 2024.
In a brief verdict, Chief Justice Qazi Faiz Isa said this was not a curative review but a case of correction in the judgment.
During the hearing, CJPIsa said that if there were flaws in the Supreme Court’s (SC) verdict in the case of Mubarak Sani, a member of the Ahmadiya community, the court would definitely make corrections.
During the hearing of review petitions filed by the federal and Punjab governments in the case, the CJP said that previously too the court had sought religious scholars’ opinions on the subject and would do this again.
Speaking on the occasion, the advocate general said that the prime minister, National Assembly speaker and members of the parliament had advised that the apex court should be approached in the case.
The chief justice said, “Jamiat Ulema-e-Islam-Fazl (JUI-F) chief Maulana Fazlur Rehman is also here. Let’s see what he has to say on the matter.”
“In fact, we will listen to the viewpoints of all religious scholars,” he added.
A three-member bench of the Supreme Court (SC), headed by Chief Justice of Pakistan (CJP) Justice Qazi Faez Isa heard the case.
Other members on the bench were Justice Naeem Akhtar Afghan and Justice Ameenuddin Khan.
The petitions seek corrections in paragraph 9 of the apex court order.
