Senator Siddiqui says 8 judges’ decision on reserved seat is full of confusions

PML-N Senator Irfan Siddiqui has said that the recent judgment of the apex court’s 8 judges is creating confusion in the society, he questioned that why there is an impression that courts and judges can not commit mistakes, reported 24NewsHD TV channel.

Addressing a press conferences in Islamabad, PML-N leader said few days back the decision of SC judges regarding the reserved seat case has created confusion and situation was becoming more complicated. He lamented that apex court often flout the decision of the parliament.

Senator Siddiqui said it should be decided right now that in case any article of law is against the constitution who will correct the decision either court or the parliament.

He said according to law all independent law makers have to join any of the political party within three day after the notification of their victories. He said law and the constitution gives lawmakers three day that is why independent MNAs joined Sunni Ittehad Council party. Now law made it mandatory for the lawmakers to remain in the party for five years.

But Supreme Court’s judges break this section of the law and allow lawmakers to join PTI. He made it clear that the right which apex court has given to law makers was illegal and courts should tell the nation from where they have obtained this right.

Irfan Siddiqui said that SC judges decision is based on the principle of convenience not on absolute justice. He said not a single lawmaker demanded of the court that they wanted to switch party. He questioned under what law court can allow lawmakers to join another party?.

He said Pakistan’s judiciary did not stand up to any martial law but always raised hue and cry over the constitutional amendment made by the elected parliament. He demanded of the apex court to tell the government what it should do and where to go.

He said Article 239 of the Constitution states that amendments to the Constitution cannot be challenged in any court but this clause has been made redundant. PML-N leader said there is no restriction on the authority of parliament, adding that due to overstepping its limits by the court, the provisions of the constitution have been paralyzed by the courts.
