After the passage 26th Constitutional Amendments, the newly-constituted Judicial Commission of Pakistan, which met under the chair of Chief Justice of Pakistan Yahya Afridi, has decided to set up 7 members Constitutional Bench which will be headed by Supreme Court’s Justice Ameen Uddin Khan, reported 24NewsHD TV channel.
According to official declaration of the meeting, the Judicial Commission made the decision with the support of 7 members of the Commission while five members of the Commission opposed the appointment of Justice Ameen-ud-Din as head of Constitutional Bench.
Out of 13, only 12 members of the Judicial Commission attended the meeting while one member remained absent. Opposition member Omar Ayub pointed out that meeting of the commission could not be proceeded because of quorum issue. However, majority of the members contended that meeting can be proceeded as per law.
According to the official announcement, members of the Judicial Commission allowed its chairman Justice Yahya Afridi to set up Judicial Commission Secretariat and rules of the Commission. On the occasion, CJP suggested that appointments of Constitutional Bench should be initiated according to Article 75 A. Moreover, CJP also suggested that Constitutional Bench should be constituted for a limited time frame. Out of 12 members, 7 members approved the formation of Constitutional Bench for a period of two months. Moreover, in the formation of Constitutional Bench, representation of four provinces was also ensured. It was agreed by majority members that Justice Amin-ud Din Khan will be head of the Constitutional Bench while other members will be Justice Jamal Mandokhel, Justice Naseem Akhtar Afghan, Justice Muhammad Ali Mazhar, Justice Hassan Azhar Rizvi, Justice Ayesha Malik and Justice Musarrat Hilali.
Justice Amin-ud-Din will be joined by Justice Ayesha Malik to represent Punjab, while Justice Naeem Akhtar Afghan and Justice Jamal Khan Mandokhail will represent Balochistan. Justice Muhammad Ali Mazhar and Justice Hassan Azhar Rizvi will represent Sindh, and Justice Musarrat Hilali will represent Khyber Pakhtunkhwa.
Judicial Commission meeting was attended by CJP Justice Yahya Afridi, Justice Mansoor Ali Shah, Justice Muneeb Akhtar and Justice Aminuddin. Attorney General Mansoor Usman Awan and Law Minister Nazir Tarar, Pakistan Bar Council representatives Advocate Akhtar Hussain and Opposition members Umar Ayub and Senator Shibli Faraz also attended the meeting of the Commission. Sheikh Aftab, Senator Farooq H Naik and Roshan Khursheed Brocha also attended the meeting. Law Minister and the Attorney General voted in favor of Justice Amin-ud-Din Khan. Pakistan Bar Council’s representative Akhtar Hussain, Farooq H. Naik, Aftab Ahmed and Roshan Khurshid Brocha also supported the appointment of Justice Amin-ud-Din Khan as head of Constitutional Bench.
CJP Justice Yahya Afridi, Justice Mansoor Ali Shah, Justice Muneeb Akhtar and Opposition members Umar Ayub and Senator Shibli Faraz opposed the appointment of Justice Amin as head of Constitutional Bench.
Justice Amin-ud-Din Khan was born on 1st December 1960 at Multan. He belongs to a very noble family of a famous lawyer of the time Khan Sadiq Muhammad Ahsan, Advocate (Late). He received his education from Kinder Garten Muslim School Multan. He completed Secondary School Education from Government Muslim High School, Multan in the year 1977. He secured his Bachelor Degree in subjects of Philosophy in the year 1981 and completed his LL.B from University Law College, Multan in 1984 and diploma in Taxation Law.
Justice Amin-ud-Din Khan started practice as Junior with his father and obtained the license to practice in Lower Courts in the year 1985. He enrolled as an Advocate of the Lahore High Court in 1987. Some years later, he was enrolled as an Advocate of the Supreme Court in 2001. He joined Zafar Law Chambers at Multan in the year 2001, till elevation remained there. He practiced in civil side mainly from trial court up to August Supreme Court and appeared in August Supreme Court in famous and important cases relating to the property, pre-emption and matters of inheritance, also these subjects remained the favourite subjects.
Justice Amin-ud-Din Khan was elevated to the Bench on 12.5.2011. During his career as a Judge, Justice Amin-ud-Din Khan decided thousand oldest cases of civil nature at Bahawalpur Bench, Multan Bench and at Principal Seat, Lahore and most judgments were upheld by the August Supreme Court of Pakistan.
