The Supreme Court of Pakistan (SCP) has dismissed the second revision petition against the Chaklala Cantonment Board case, the 24NewsHD TV channel reported on Sunday.
A citizen Khalid Mehmood filed a petition in the apex court requesting for a second review of the Chaklala Cantonment Board case, but the court came hard on it saying a decision cannot be reviewed for a second time.
An additional note was issued by Justice Mansoor Ali Shah regarding the second revision held that the Supreme Court does not have the power to automatically review any decision.
Justice Mansoor Ali Shah further remarked that there is a big difference between the constitutions of India and Pakistan. “Curative review is not applicable in Pakistan due to differences in the constitutions and judicial powers, his additional note maintained.
The learned court observed that no other revision is possible under any name, curative or automatic.
Justice Mansoor Ali Shah's note further hinted that spontaneous review is not mentioned in the Constitution nor in the Supreme Court Rules.
The additional note further held that the curative review also has no scope in the Constitution and Supreme Court Rules.
“Article 175(2) makes no law authorizing second revision, additional note added.
