IHC larger bench to hear Imran’s alleged daughter case

In an important development in former prime minister and PTI Chief Imran Khan’s alleged daughter Tyrian White case, the Islamabad High Court (IHC) on Tuesday constituted a larger bench, reported 24NewsHD TV channel.

The three-member bench, headed by IHC Chief Justice (CJ) Justice Amir Farooq, would begin hearing of the case on February 9.

Other judges on the bench are: Justice Mohsin Akhtar Kiani and Justice Arbab Muhammad Tahir.

IHC’s Registrar Office issued the cause list.

Imran is facing the allegation of not disclosing his alleged daughter in his nomination papers.

Muhammad Sajid, a citizen, had filed a petition in the court, seeking disqualification of Imran.

Five days ago, on February 2, 2023, Salman Akram Raja, representing Imran Khan, told the IHC that he would contest the maintainability of the petition since his client was no more a member of the National Assembly after tendering his resignation from the parliament.

In his preliminary objections submitted before the court, Imran, rather than answering the questions, objected to the maintainability of the said writ petition on following technical grounds:

– That he is no more a member of NA w.e.f 19.09.2022, therefore no longer answerable as a public office holder. 

– That Islamabad High Court had earlier refused to probe into similar allegations (refers to 2018 case). 

– That four judges who formed part of Islamabad High Court had earlier recused themseleves from hearing the same matter therefore cannot again sit on the same matter.
