In order to take part in general elections, former premier and PTI founder Imran Khan has moved to the Supreme Court to seek suspension of the Islamabad High Court decision regarding his conviction in the Toshakhana criminal case, reported 24NewsHD TV channel on Saturday.
The petition was filed through Advocate Latif Khosa in the Supreme Court.
In his petition, Imran took the stance that disqualifying him before the elections is against his fundamental rights.
He said that the Election Commission showed haste and disqualified him for five years under Article 62 1F on August 8, while the Pakistan Tehreek-i-Insaf was also deprived of the party symbol ‘bat’.
Imran Khan requested that the decision of the Islamabad High Court should be annulled and the decision regarding his conviction in the Toshahhana case should be suspended.
He took a position that the Supreme Court has already suspended the sentence in the Toshakhana case, the High Court only suspended the sentence, but not the entire decision, the Election Commission took advantage of the error in the High Court decision, and issued a notification disqualifying the PTI founder.
The petition requested the Supreme Court that the elections are near, the PTI founder is the former prime minister of the country, the leader of the largest party of the country cannot be kept out of the elections.
The petitioner implored the Supreme Court to suspend the decision of his sentence in the Toshakhana case so that he could participate in the elections. S
However, the Supreme Court Registrar’s Office returned the petition after raising objection to it.
The registrar’s office said that relevant documents have not been attached with the appeal and the appeal could be filed by January 6 after attaching all relevant documents.
