LHC disposes of Pervaiz Elahi’s recovery case
Rules ex-Punjab CMi’s arrest in another case has rendered petition ineffective: Hearing of contempt case against police officer adjourned

The Lahore High Court (LHC) on Wednesday disposed of the case of recovery of former Punjab chief minister and PTI President Chaudhry Pervaiz Elahi, saying the petition filed in this regard had become ineffective after the arrest of the petitioner in yet another case, reported 24NewsHD TV channel.
However, the court made it clear that contempt of court proceedings against the officers would continue.
In his written order, Justice Mirza Waqas Rauf said that hearing of the petition, seeking initiation of contempt of court proceedings, was postponed until September 18.
The Lahore High Court had yesterday (Tuesday) adjourned the hearing of Chaudhry Pervaiz Elahi’s case while directing the Islamabad chief commissioner and IG police to safely produce the former Punjab chief minister in the court tomorrow.
The court summoned the Islamabad chief commissioner and IG police in person in the court tomorrow. The court also issued contempt notices to Attock DPO, Rawalpindi CPO and Attock Jail superintendent for not showing up in the court.
Justice Mirza Waqas Rauf on Tuesday heard Qaisera Elahi’s petition challenging the arrest of her husband and seeking contempt proceedings against the Islamabad police.
During the hearing, Elahi’s lawyer said that his client should be presented in the Lahore High Court.
The court ordered the Islamabad chief commissioner and IG police to present the PTI leader tomorrow.
The federal government lawyer said that they had challenged the court order, pleading with the court to hear their requests before producing Elahi in the court.
The judge remarked that he was only saying that the order of the court must first be implemented.
Earlier, the court summoned Islamabad chief commissioner, IG police and Attock Jail superintendent till 11 am when they did not show up for the case hearing.
The court expressed its displeasure at not producing Pervaiz Elahi. It also displayed its annoyance over the non-appearance of the Islamabad IG and issued show cause notice to him.
The court declared that there was a clear order of the court to produce Elahi and asked the government lawyer to appear and explain.
Punjab Additional Advocate General Ghulam Sarwar Nahang told the court that Parvaiz Elahi was not presented due to heart problem, Islamabad DC prohibited him from traveling due to illness.
He said that Elahi has been detained by the Islamabad DC under the threat of public order.
Nahang opposed the petition for habeas corpus pleading that the petition was no longer justified.
Deputy Superintendent of District Jail Attock and District and Sessions Judge Attock appeared as bailiffs. The report submitted to the court said that Elahi could not be recovered due to detention.
